Brighter Workdays Terms & Conditions

1. Acceptance of Terms 

By registering for and using the Brighter Workdays application, you are entering into a binding contract with us and agree to comply with these Terms and Conditions. If you do not agree to these terms, you must not use our services.

2. Description of Service 

Brighter Workdays is a UK-based employee mood tracking service designed to support organisations in improving workplace well-being. This service collects anonymous mood feedback from employees and provides organisational insights via analytics.

3. User Responsibilities

  • Use of Brighter Workdays must comply with all applicable UK laws and regulations.
  • You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
  • You must ensure all information provided during account registration is accurate and kept up to date.

4. Privacy and Data Protection

  • Our commitment to your privacy is paramount. Our App Privacy Policy outlines our data handling practices and is aligned with the UK Data Protection Act 2018 and the General Data Protection Regulation (GDPR).
  • You confirm that any data you provide, including personal data of employees, complies with the Data Protection Act 2018 and that you have obtained all necessary consents.

5. Intellectual Property Rights 

All intellectual property rights in the Brighter Workdays service, including but not limited to its design, text, graphics, and software, belong to us or our licensors and are protected by UK and international copyright laws.

6. Limitations of Liability 

To the extent permitted by law, Brighter Workdays will not be liable for any indirect or consequential losses arising out of or in connection with the use of our service.

7. Changes to Terms 

We reserve the right to modify these Terms and Conditions at any time. Continued use of Brighter Workdays after such changes shall constitute your consent to such changes.

8. Termination 

We may terminate or suspend your access to our service immediately, without prior notice, for any breach of these Terms.

9. Governing Law and Jurisdiction 

These Terms and Conditions are governed by the laws of England and Wales and are subject to the exclusive jurisdiction of the English courts.

10. Trial Period

Users who sign up for Brighter Workdays are offered a 30-day free trial to fully evaluate the service. No payment information is required to initiate this trial.

11. Subscription Activation

To continue using Brighter Workdays services after the initial trial period, users are required to set up a valid payment method. If a payment method is not established by the end of the trial, the account will automatically be marked as inactive, and access to the services will be suspended until payment information is provided.

12. Subscription Fees

Upon successful setup of a payment method, and following the conclusion of the free trial, users will automatically enter into a paid subscription agreement. The subscription cost is based on the number of active seats (users) each month. By setting up a payment method and not cancelling the service before the trial ends, you agree to our subscription fees.

13. Payment Terms

Subscription fees are billed monthly, in advance, based on the number of active users at the start of each billing cycle. These fees are non-refundable. Users are responsible for maintaining current billing information and authorise Brighter Workdays to charge the subscription fee to the designated payment method.

14. Changes in Subscription Fees

Brighter Workdays reserves the right to modify subscription fees or to introduce new charges. Any changes will be communicated at least 30 days in advance, either through email or via a notification on our website.
